2. Scope
These Terms & Conditions apply to every offer made by Didi Depressi and to every distance contract concluded through dididepressi.com between Didi Depressi and a customer.
By placing an order, the customer confirms that they have read and accepted these Terms & Conditions.
Any deviation from these Terms & Conditions is only valid if confirmed in writing by Didi Depressi in advance.
Where the customer is a consumer, these Terms & Conditions do not affect any mandatory statutory consumer rights.
3. Products and Product Information
Didi Depressi sells clothing, accessories and other lifestyle products.
We make every reasonable effort to display products, colours, dimensions, materials and designs as accurately as possible.
Colours may vary slightly depending on screen settings, the device used, the production method or minor differences between production batches.
Measurements and sizing information are indicative and based on the size chart provided. Minor variations that are inherent to the production process will not automatically be considered a defect.
Where applicable, relevant information regarding materials, sizing and care instructions will be provided on the product page or product label.
4. Offers
All offers remain valid for as long as they are displayed on the website and while stock or production capacity remains available.
Obvious errors, typing mistakes, technical errors or clearly incorrect prices do not bind Didi Depressi where a reasonable consumer should have understood that an error had occurred.
If an ordered product unexpectedly becomes unavailable, we will inform the customer as soon as reasonably possible. Any amounts already paid for the unavailable product will be refunded.
5. Conclusion of the Agreement
The agreement is concluded when the customer:
- adds the desired products to the shopping cart;
- enters the required order and contact details;
- accepts the applicable Terms & Conditions;
- confirms the order with an obligation to pay.
After placing an order, the customer will normally receive an electronic order confirmation.
6. Prices
All prices on dididepressi.com are displayed in euros unless expressly stated otherwise.
Prices shown to consumers include applicable VAT.
Any shipping costs and other applicable charges will be displayed before the order is finalised.
Didi Depressi may change prices at any time. A price change will not affect an order that has already been validly placed.
Where price reductions are advertised, applicable legal rules concerning reference prices will be followed.
7. Payment
Available payment methods are displayed during checkout.
Payments may be processed by third-party payment service providers. Their own terms and privacy policies may also apply.
Orders may only be processed after payment has been successfully received or confirmed, unless another payment method has expressly been offered.
8. Production and Print-on-Demand
Some Didi Depressi products may only be produced, printed or embroidered after an order has been received.
The fact that a standard product is only produced or printed after an order has been placed does not automatically remove the consumer’s statutory right of withdrawal.
The statutory exception for personalised products will only apply where a product is genuinely manufactured according to the customer’s individual specifications or is clearly personalised, for example by adding a customer-selected name, custom text, image or other individual customisation.
A standard Didi Depressi design that is available to all customers will not be treated as a personalised product solely because it is produced on demand.
9. Delivery
Orders will be delivered to the address provided by the customer during checkout.
The customer is responsible for entering the delivery address correctly.
Available delivery countries, shipping methods, estimated delivery times and shipping costs will be displayed on the website or during checkout.
Any stated delivery time is an estimate unless a guaranteed delivery date has expressly been agreed.
Where an order consists of multiple products, products may be shipped separately.
Didi Depressi is not liable for delays caused exclusively by circumstances outside our reasonable control, without prejudice to the consumer’s statutory rights.
10. Damaged or Incorrect Deliveries
If the customer receives a damaged, incorrect or incomplete product, we ask them to contact us as soon as possible at:
Please preferably include:
- the order number;
- a description of the issue;
- where relevant, clear photographs.
This practical notification procedure does not limit the consumer’s statutory warranty rights.
11. Statutory Guarantee
Consumers benefit from the statutory legal guarantee of conformity.
For new consumer goods, this guarantee generally lasts for two years from delivery in Belgium.
Products must, among other things, correspond to what was ordered and have the qualities that a consumer may reasonably expect.
Where a product lacks conformity, the consumer has the rights provided by applicable law, including, depending on the circumstances, free repair or replacement and, where the legal conditions are met, a price reduction or termination of the agreement.
Nothing in these Terms & Conditions limits the statutory guarantee.
Normal wear and tear, damage caused by improper use, failure to follow care instructions or damage caused by the customer does not in itself constitute a lack of conformity for which Didi Depressi is legally responsible.
12. Right of Withdrawal
Consumers making an online purchase generally have the right to withdraw from the agreement without giving a reason within 14 days.
For goods, the withdrawal period generally starts on the day after the consumer or a third party appointed by the consumer, other than the carrier, physically receives the goods.
Where one order is delivered in several separate shipments, the period generally begins upon receipt of the final product.
To exercise the right of withdrawal, the consumer must clearly inform us of their decision to withdraw before the withdrawal period expires.
This may be done by email at:
or by using the Model Withdrawal Form available on our website.
Use of the Model Withdrawal Form is not mandatory.
13. Returning Goods After Withdrawal
After notifying us of the withdrawal, the consumer must return the relevant products without undue delay and no later than 14 days after giving notice of withdrawal, unless Didi Depressi agrees otherwise in writing.
Return address:
Didi Depressi / Furever Friends
Peperstraat 20
9220 Hamme
Belgium
We recommend using a tracked shipping method. The risk of the return shipment generally remains with the sender until it reaches us.
The consumer bears the direct cost of returning the goods unless Didi Depressi has expressly agreed in advance to cover those costs or the return results from an error or defect for which Didi Depressi is responsible.
14. Condition of Returned Products
The consumer may inspect and assess the product in the same way as would reasonably be possible in a physical shop.
The consumer may be liable for any reduction in value caused by handling the product beyond what is necessary to determine its nature, characteristics and functioning.
Where reasonably possible, we ask that products be returned with their original labels and packaging.
The absence of original packaging does not automatically remove the statutory right of withdrawal.
15. Exceptions to the Right of Withdrawal
The right of withdrawal does not apply where a statutory exception applies.
This may include:
- products made according to the customer’s individual specifications;
- clearly personalised products;
- sealed goods which are not suitable for return for health protection or hygiene reasons and which have been unsealed after delivery, where the legal requirements for this exception are met;
- any other situation in which applicable law expressly excludes the right of withdrawal.
Where a product is excluded from the right of withdrawal under a statutory exception, we will try to make this clear on the relevant product page before purchase.
16. Refunds Following Withdrawal
Where the consumer validly withdraws from the entire order, Didi Depressi will refund all payments received for that order, including the cost of the least expensive standard delivery method offered for the order.
Any additional amount paid because the consumer voluntarily chose a more expensive delivery option does not need to be refunded.
Where only part of an order is returned, the original delivery costs will not be refunded insofar as those delivery costs would also have been payable for the products retained by the consumer.
Refunds will be made without undue delay and within the period required by law.
For sales of goods, we may withhold the refund until we have received the returned products or until the consumer provides evidence that the goods have been returned, whichever occurs first.
Refunds will normally be made using the same payment method used for the original transaction, unless otherwise agreed.
17. Returns Outside the Statutory Withdrawal Period
Once the statutory withdrawal period has expired, there is no automatic right to return a product simply because the customer has changed their mind, unless Didi Depressi expressly offers a broader commercial return policy.
This does not affect rights relating to incorrect, damaged or non-conforming products.
18. Gift Cards and Promotions
Where Didi Depressi offers gift cards, discount codes or promotions, additional terms may apply.
Discount codes cannot be exchanged for cash unless required by law.
Unless otherwise stated, discount codes cannot be combined.
Promotional offers never restrict a consumer’s statutory warranty rights.
19. Intellectual Property
All text, logos, illustrations, designs, images, graphic elements, product designs and other content on dididepressi.com are protected by applicable intellectual property rights insofar as those rights belong to Didi Depressi or its licensors.
Without prior permission, such content may not be commercially copied, reproduced, distributed or used except where permitted by law.
20. Liability
Didi Depressi is liable in accordance with applicable law.
Nothing in these Terms & Conditions is intended to exclude liability where such exclusion is prohibited by law.
Didi Depressi is not responsible for damage caused exclusively by improper, unintended or unforeseeable use of a product.
21. Force Majeure
Where performance of the agreement becomes temporarily impossible or significantly more difficult due to an event outside Didi Depressi’s reasonable control, performance may be suspended for the duration of that event.
The statutory rights of consumers remain unaffected.
If performance becomes permanently impossible, amounts paid for undelivered products will be refunded where required by law.
22. Complaints
We prefer to resolve issues directly with our customers.
Complaints may be sent to:
Where possible, please include your order number and a clear description of the complaint.
We aim to deal with complaints within a reasonable period.
If a dispute cannot be resolved directly, Belgian consumers may obtain information about out-of-court dispute resolution through the competent Belgian authorities, including the Consumer Mediation Service.
23. Applicable Law and Jurisdiction
Agreements with Didi Depressi are governed by Belgian law.
For consumers, this choice of law does not deprive them of any mandatory protection they may have under the law that would otherwise have applied.
Disputes will be submitted to the court having jurisdiction under applicable law.
24. Amendments
Didi Depressi may amend these Terms & Conditions.
An order will generally be governed by the version of the Terms & Conditions that applied at the time the order was placed, unless applicable law requires otherwise.
The latest version will always be available on dididepressi.com.
